These terms govern your use of Gemynd's software. If you are using the Services on behalf of a funeral home or another business, you are agreeing on its behalf and confirming you have authority to do so.
By creating an account or using the Services, you agree to these terms. If you do not agree, do not use the Services. If a signed agreement exists between your organization and Gemynd, that agreement controls where it conflicts with these terms.
Gemynd LLC provides the WestFlow suite, including Story Scribe, FlowVault, FlowHub, FieldFlow, FlowView, and AIVA. The Services help organize documents, track records, and produce narratives, keepsakes, and reports. We may add, change, or discontinue features. If we discontinue a Service you rely on, we will give reasonable advance notice.
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly at support@gemyndflow.com if you believe your account has been compromised. You must be at least 18 years old to create an account.
You keep ownership of everything you upload. Photographs, documents, recordings, and text remain yours, or the property of the family or organization you act for.
You grant Gemynd a limited license to host, copy, transmit, process, and display that content solely to provide the Services to you — including transmitting it to the AI providers we use for processing. This license ends when you delete the content or close your account, except for copies retained in backups for a limited period.
We do not use your content to train general-purpose AI models, and our providers are contractually restricted from doing so.
You represent that you have the right to upload what you upload, including the right to share photographs and records of a deceased person, and that doing so does not violate anyone's rights.
Parts of what the Services produce are generated by AI, including narrative text, illustrations, narration, and animated portraits. Generated output is labeled in the product where it appears.
Story Scribe traces the sentences in a narrative to the sources they came from and shows you those sources. That tracing is a feature, not a guarantee. AI can misread a document, misattribute a fact, or produce text that reads as certain when the underlying source is not.
You are responsible for reviewing output before delivering it to a family or publishing it. Every Service that produces a narrative provides a review step for this reason. Do not skip it.
Gemynd is not responsible for decisions made in reliance on AI output, or for errors in output you approved.
Some Services organize records that carry legal or regulatory weight — authorizations, certificates, and compliance documentation. The Services help you see what is present and what is missing. They do not determine whether your practice complies with any law or regulation, and they are not legal, medical, or professional advice.
You remain responsible for your own regulatory obligations, record retention, and professional judgment. The Services are a tool, not a substitute.
You may not:
We may suspend or terminate access for violations.
The Services let you generate links that others can open without an account. Anyone holding such a link can view what it points to for as long as it remains valid. You are responsible for who you send them to.
Pricing, billing periods, and payment terms are set out in your order form, subscription page, or separate agreement. Fees are non-refundable except where required by law or expressly stated otherwise. We may change pricing with at least 30 days' notice before a renewal term. Some features consume usage-based resources and may be subject to limits described at the time of purchase.
The Services, including software, design, and documentation, are owned by Gemynd and protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the Services. Our names and logos may not be used without written permission.
If you send us feedback or suggestions, we may use them without obligation to you.
The Services integrate with third-party systems, including funeral home management platforms, cloud providers, and AI providers. We are not responsible for those services, their availability, or their terms. Your use of an integration may be governed by that provider's agreement as well as this one.
We work to keep the Services available but do not guarantee uninterrupted operation. We may perform maintenance, and outages may occur. Unless a separate agreement says otherwise, the Services are provided without a service level commitment.
You may stop using the Services and close your account at any time. We may suspend or terminate access for breach of these terms, non-payment, or if required by law. On termination, your right to use the Services ends. You may export your content before closing your account; after closure we handle deletion as described in our Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GEMYND DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, THAT OUTPUT WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMYND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES.
GEMYND'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID GEMYND IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will defend and indemnify Gemynd against claims arising from content you upload, your use of the Services in violation of these terms, or your violation of the rights of a third party.
These terms are governed by the laws of the State of Georgia, without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Forsyth County, Georgia, and each party consents to that jurisdiction.
We may update these terms. Material changes will be posted here and, for account holders, sent by email at least 30 days before they take effect. Continued use after that date means you accept the updated terms.
If a provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of assets. These terms, together with the Privacy Policy and any signed agreement, are the entire agreement between us.
